Welcome to Divine Property by Alloggio.
These Terms and Conditions constitute a legally binding agreement between Alloggio Management and the Guest. You acknowledge that you agree to and are subject to these Terms and Conditions on behalf of yourself and all persons named or otherwise travelling on your booking.
Reference to “Alloggio Management” in these terms and conditions is a reference to Alloggio Management NZ Ltd NZBN 9429051673611 which in turn is owned by Alloggio Management Pty Ltd ACN 618 814 556. Individual brands controlled by Alloggio Management NZ Ltd may have additional terms and conditions (secondary to these terms & conditions) as outlined within this website and need to read and adhered to in conjunction with the overall Alloggio Management Pty Ltd Terms and Conditions.
Terms and Conditions Reference:
The master/source terms and conditions, serving as the foundational document governing the use of our services, can be accessed, and reviewed at CLICK HERE For additional, brand-specific terms and conditions, please refer to the detailed terms provided below. In the event that specific terms within the brand's terms and conditions do not reference the master/source terms and conditions as the basis, it should be understood that the master/source terms remain the overarching framework for all terms and conditions related to our services.
The conditions that are outlined for “Divine Property” are nuanced to supersede those that are generic within Alloggio Management Holiday’s page within the Trova Website that are specific to the guests of Divine Property.
Your details
The guest may only agree to these terms and conditions if they can form a legally binding contract that is enforceable against them. The guest must be at least 20 years old. The guest must be one of the guests staying for the duration of the Term.
The guest agrees to provide complete, accurate and current information when listing or booking accommodation
Cancellations
Please note that we quote, receive payment and refund in NZD. We are no liable for any loss due to exchange rates or credit card process fees.
Refer to Online Travel Agents (example: Booking.com, Expedia, VRBO, Airbnb) cancellation policy for full details on any applicable refund.
Acknowledgement
The guest acknowledges that they will read the Holiday Home Compendium in full as provided by Divine Property Management (at confirmation, prior to arrival, on vacating and located inside the property for full obligations at each private holiday home).
The guest acknowledges that he/she/they, is/are responsible to the owner for all breakage, destruction, costs, fines incurred or damaged caused to the Holiday Home, including any contents, by the guest during the Term. The guest must immediately reimburse Divine Property Management for all such breakages, destruction, destruction, costs, fines, or damage.
The guest must report any damage, breakage, accident, or injuries to Divine Property Management to Divine Property Management immediately. In no circumstances is the guest to arrange or attempt any repairs without Divine Property Management’s approval.
The guest agrees to immediately inform the owner if they come across any hazard at the Holiday Home that could be deemed to be a risk to life, injury, or the property.
The guest is liable for any excessive cleaning required over and above the allocated hours (found in the property manual for your property) received on confirmation and is in your holiday home on arrival.
If the Term is more than 14 days, Divine Property Management may request to increase the standard bond/holding deposit from the guest, to be held by Divine Property Management Trust until the end of the Term. The bond is held by Divine Property Management shall not limit any liability of the guest.
Occupation of the Holiday Home
The guest may not allow more people that is permitted in the terms of the confirmation or as set out on the website to occupy the Holiday Home.
The guest may not sublease the Holiday Home to another guest.
The guest must be present for the full term of the rental.
There is a no smoking policy in the Holiday Home.
No pets are permitted onsite.
The guest agrees to comply with local bylaws including noise control.
The outdoor areas (including spa pool areas if appliable) are restricted to sue between 0700hrs and 2200hrs
The guest agrees the Holiday Home will no be used for business purposes.
The guest agrees that large gatherings, functions such as weddings and parties are prohibited at the Holiday Home.
Divine Property Management may terminate the Agreement if:
· The permitted number of guests is exceeded; and
· Divine Property Management has notified the rented of their breach of the Agreement and the rented has failed to rectify the breach within 2 hours of receiving notification from Divine Property Management.
· If any of the above terms and conditions are not met.
Additional Facilities available in the Holiday Home (if the property you have booked is listed as having them)
Communal or Private Spa Pool:
· The rented uses the spa pool at their sole risk.
· Every effort has been made to ensure the safety of small children who may be staying at the holiday home or who may be visiting. The spa pool lid is always closed and locked when not in use.
· The guest agrees to chemical does the pool as per the instructions at the Holiday Home and agrees to contact Divine Property management if they have any concerns about the chemical dosing. The guest uses these chemicals at its sole risk.
Communal or Private Gym:
· The guest uses the gym and equipment at their sole risk
· No children under the age of 12 years old should be allowed on the equipment, machines or to use the free weights
BBQ’s
· The guest must turn off the gas bottle when not in use
· The guest must make sure the BBQ is left in a clean state or extra cleaning will be passed on.
Rubbish and Recycling
· The guest must adhere to all instructions provided at the Holiday Home and the Holiday Home Compendium on the correct disposal of rubbish. Failure to adhere to this will result any charges for removing cross-contaminated rubbish being passed on at a minimum charge of $150 plus GST per cross-contaminated bin.
Any other facilities provided as part of the Holiday Home and any instructions on their use during their stay as found in the Holiday Home Compendium provided.
Guests Chattels and Personal Belongings and Lost Property
The owner accepts no responsibility for any loss, or damage, to any of the guests’ chattels or personal belongings at the Holiday Home during the Term.
Divine Property Management will do their best to locate lost property at request of the guest. The guest agrees to compensate Divine Property Management for any costs and labour in retrieving and posting back lost property.
Complaints
If the guest is not entirely satisfied with the Holiday Home, they must immediately contact Divine Property Management. In the unlikely event that a complain of the guest is not addressed by Divine Property Management during the Term, the guest may make their complaint in writing to Divine Property Management, within 7 days after the end of the Term.
Arbitration
Should any dispute arise between Divine Property Management and the guest which cannot be mutually resolved, the matter shall be refereed to an arbitrator if one can be agreed upon, or failing agreement, to the President of Arbitrators and Mediators Institute of New Zealand to appoint an arbitrator. Any such arbitration is to be carried out in accordance with the provisions of the Arbitration Act 1996 and all decisions will be deemed final.
Health and Safety
The guest agrees to immediately inform the owner if they come across any hazard at the Holiday Home that could be deemed to be a risk to life, injury, or the property.
Insurance
The guest undertakes that it will not do, or omit to do, any action that would invalidate or adversely affect any insurance policy held by the owner of the property, including securing and alarming the house when absent, in respect of the Holiday Home and/or its contents.
Privacy Act 1993
All information obtained by Divine Property Management in respect of the guest and in particular the guest/s financial circumstances, is for Divine Property Management requirements to determine the credit worthiness of the guest. The guest authorises the owner to exchange this information with a credit agency. The guest understands that if the guest defaults on any payment under this Agreement, that a default may be listed with a credit agency. Any information provided to a credit agency is available by other uses of that agency’s services.
Residential Tenancies Act 1986
Divine Property Management and the guest agree this Agreement is not subject to the RTA 1986 as the term shall not exceed 90 days.
Governing Law
These terms and conditions are governed by the laws of New Zealand. The guest submits to the non-exclusive jurisdiction of the Courts of New Zealand.
Force Majeure and Non-Availability
Divine Property Management is not responsible for the non-availability or the early termination of the Agreement for any matter or reason which is beyond its control.
As property managers we accept bookings on behalf of the owners, therefore we cannot be held responsible should the property become unavailable due to:
· The owner’s decision to withdraw the property either temporarily or permanently (i.e., for the sale of the property, alterations/repairs, or personal use)
· Circumstances beyond our control such as acts of God, fire, flooding, and unexpected repairs and maintenance issues. In the event of any of these situations we reserve the right to cancel the booking, however, every effort will be made to find alternative comparable accommodation for the intended dates of stay. No further compensation will be offered.
Amendments to the terms of the Agreement
These may be amended at any time by the owner. Any amendments shall be accepted by the rented upon the execution of an acknowledgement setting out the amendments.
